Thank you to everyone who emailed or commented yesterday in response to my Cease and Desist post. My legal advisor has confirmed 99% of what I, and most of you, thought. I have nothing to fear since I have done nothing that is in any way actionable. I have simply given an opinion based on what I have seen and read.
However, it is not all good news. I have been advised, very strongly I might add, to not make the order public nor to reveal the identity of the person behind the action until everything is dealt with. Much as I would love to reveal all straight away I need to keep one eye on what could happen. If I ignore the advice I have been given it will make things more difficult for my legal representative to fight my corner. I can just picture him saying “I told you not to do it, now you’ve made things worse” and shaking his head. I don’t think either of us want that.
Of course, that doesn’t prevent me from posting the details once everything is sorted out and I’m sure that the temptation will be too great once the coast is clear.
It is also worth noting that the complainant has already contacted my host, AN Hosting, in an attempt to get Upstart Blogger taken down. I am very happy to report that AN Hosting do not have a shoot first, ask questions later, attitude and have simply asked me to keep them in the loop. I have their assurance that my site will stay online since they believe that I have done nothing wrong. It’s very nice to know that they are supporting me.
The public outing of the complainant is on hold for a little while until everything is taken care of. Rest assured, I’m not taking this one lying down.






I think you’ve made the right call,
It seems this person is trying to goad you into doing something they can actually use to silence or discredit you.
Keeping a cool head shows that Upstart is in safe hands. I’m sure AN have noted that as well.
